Overview of the cjs process: detection and investigation. Scope & extent of police investigation can vary. Initiate an investigation ex drug offences, child pornography, and react when told. By a victim and by the police. Police start talking to the mom, dad, the kids, the motel they stayed in and etc. To bring formal charges: police must have reasonable and probable ground to believe that an individual has committed an offence. Police can bring about charges depending on the offence. Police do not have discretion if the crime is more severe than others. Formal is when the police arrest someone. Informal is like community service, not sent to the court. Police can use this discretion when it comes to less serious offences. Obtain a summons or appearance notice: when a police writes a report and the person will be sent home. If it"s a less period offence you will be sent to court, but you will be released.
