Treat sentencing as important as criminal trial. Offenders go through stages of grief denial, anger, bargaining, depression, acceptance. Starting at day one, he discusses mitigating circumstances and makes them do community service, so it will look better for sentencing. He does his own pre sentence report, and he prepares his client. You need to know what court resources are available to the client- if they are aboriginal etc. if they have mental health issues, there is resources for that. It is important to recognize aggravating and mitigating factors. The best lawyers are not generally the best sentencing lawyers. Of the few cases that make it to court, half of those result in plea. It is about making your client human. Last year there were 12,390 cases in ottawa. In any given day in ottawa there are 7 or 8 trials running. People have 8-10 months to be tried approx.
