Jefferson was also concerned about entrenched judicial power. 1803 (marbury v. madison): this case threatened direct confrontation between the judiciary and executive legislative branches of the government; there was a precedent of court invalidating federal laws that conflicted with the federal constitution. Of all the branches, the judicial one is the weakest.
