Search and seizure: section 8 of the charter protects against unreasonable search or seizure, for search to be reasonable, authorized by law, manner of the search must be reasonable. Law must be reasonable: generally, police must obtain a search warrant, searches permitted without a warrant, during an arrest for protection, to prevent destruction of evidence, or for means of escape. In emergency situations (e. g. , disconnected 911 call: the search could not be humiliating - for example, police officer overturns your purse on the hood of the car and you have a prescription drug and now everyone knows. Demonstrated threat: level of potential danger posed by an individual, five levels of resistance, cooperative, non-cooperative, resistant, combative, showing the potential to cause grievous bodily harm or death.
