Judge/ jury to listen to both sides, makes sure this system works fairly. People who not there only by body, but their mind is there too. Not just mentally ill, even those who are physically ill. Their minds might not be there if they had a stroke & etc. People with mental disorders are cognitively and emotionally impaired. People who were there at the scene but can"t recall details due to their disorder.
