What is the difference between social justice and criminal justice: criminal justice system is only dealing with criminal law; monitor/control individuals who have violated criminal law, based on values and beliefs regarding morality of contemporary society. Substantive justice: the correctness of the law and the accuracy of case outcomes. The adversarial system (this is canadian justice system) Both parties hope to win the case. Trial is heard by impartial fact-finders (the judge and/or jury) who determine the guilt or innocence of the accused. They ensure that proper legal procedures are followed. (ex. Ensuring that the evidence was not obtained illegally, ensure that lawyers don"t conduct improper interrogation). The result should be a fair prosecution and trial and a just outcome; this increase legitimacy of the general system and it ensures civilian that proper sentence was delivered.
