Criminal justice is not equal to distributive justice. Justice: distributive, scarcity is a reality, we can never have enough for everyone, fundamentally ethical, ex. Discrimination: can be bad in aristotle"s term, can be good- ex. Discriminately chose western over brock because we had the choice: when misused = wrongful behaviour, what it actually means, evaluating and choosing between candidates, equal consideration, free from intentional bias, recognizing encultured bias. Are the risks taken mostly by one group and the benefits enjoyed by another group: ex. Prostitutes in thailand, who took risks to attempt to create hiv cure. Substantive or material question of justice: answers the question who should receive care first". It states what we value and why we choose one over the other. Procedural or process question of justice answers the question how we apply the answer to who goes first . It is the application in real life, of our beliefs that answer #1.
