Tobacco companies suing the government over legislation trying to get legislation unfavourable to them struck down unsuccessful for several reasons. Takes place in the us canadian courts don"t have to follow but we do look at them. Us cases are decided by juries, and juries tend to believe that people are assuming the risk when they decide to smoke. People are suing tobacco companies over the proper use of legal product, not product liability cases unusual. Fear of the consequences of a win could open for litigation against other products. Legal strategy tobacco companies are rich, they can drain the resources of people who are suing them. If it takes years to go to trial, in the meantime the two parties are going to court over more minor issues, still racking up legal fees. Companies can keep trying for motions to delay plaintiff runs out of money and has to drop.
