Had a previous finger injury and was cleared to play football. Neck injury apparent head was not up and neck was not extended at time of contact. Fracture of lamina and vertebral shift; medical treatment received was great (outcome obviously not) Duty of care owed that of a careful, prudent parent. Plaintiff claimed careful/prudent parent was too low standard of care (supraparental) Tackling taught to keep head up and contact with shoulders in 3 seasons; injury caused by axial loading which means hit with head first. Neck canadian amateur football association did have info on lean necks, but coaches and board not aware. It says the family doctor should make the decision, but he was unaware as well; court of appeal supports tj findings because it was a condition not widely known. Cafa manual only for those who were certified. Tj didn"t think appellant even had a lean swan neck.
