Health care practitioners becoming more governed by law (american concept) 4-fold increase in number of civil suits against canadian physicians (1976-2015) 65-fold increase in total cost of responding to civil claims and other legal matters. 4 judgements for plaintiffs, 55 for physicians, 250 settlements, 483 dismissed or abandoned. Admins of health institutions have increased responsibility to make sure that all laws are being followed + prevention. Some of the responses are cumbersome, costly, unnecessary, counterproductive. Other healthcare professionals also have increased litigation but less than physicians. Health professional as a party (small role), witness (more likely), compliance officer and consultant. Lots of agencies need assigned consent (law requires valid consent), and signatures preventative measure. Law recognizes old, young, physically and mentally disabled patients who are competent are entitled to make their own decisions, regardless of next of kin wishes. Caught between confidentiality obligations expectation of parents.
