The mental health act (mha), personal health information protection act (phipa) and other provincial health statutes contain detailed provisions authorizing disclosure. The health protection and promotion act (hppa) and a growing number of other provincial statutes contain mandatory reporting obligations that require disclosure of patient information without consent. Disclosure may also be required pursuant to the federal and provincial evidence acts. Health professionals may be compelled by a search warrant, subpoena or other court order to disclose patient information: implicit consent. Implied right to: share confidential information in compassionate circumstances, undertake an internal audit, ensure the quality of the services provided, carry out routine internal administrative and management tasks. A person who has expressly consented to disclosing his or her health or personal information cannot later complain when that consent is acted upon.
