Document Summary

Canada is a nation of laws meaning everyone, including the government, must obey the law. A court of appeal cannot reverse a decision of a jury, it can only order a new trial. A set of rules established and enforced by the government. A good law is something that is easily understood, however many laws are difficult to understand. Some barriers to the law include language, religious, socio-economic, financial, etc. Laws come from constitution (most important, most supreme), common law, statutes and legislations. Civil law is based on a comprehensive code (quebec, parts of europe) Common law is based on previously decided case. Public law involves the government while private law involves two individuals or business"s. Customs and conventions (i. e. we have a prime minister just because that is how it has always been, not because it is written down somewhere) When rights come into conflict, it is the courts job to decide which right is more important.
