Facts: mr. clendenning rented a car from tilden, who boasted their fast service, when he was renting his car, they asked him if he wanted the extra insurance coverage and he got it, paid extra. Look at the clause on the back of the contract that says if you consume any alcohol, you"re not insured. Original trial ruling: clendenning (def. ) won at trial because of his claim that he can"t be bound by terms that he didn"t know about. They sued and won because doesn"t matter that they said it would work verbally, because bound by what sign, even if do not read. ) No warranties, must accept what it says in the agreement. As far as we"re concerned, when you have a document like this, you"re bound to things you know nothing of and tilden knows you know nothing about those terms (they"re even supposed to divert your attention)
