Summary offences are very minor crimes that have a less than 6 months sentence (only judge decides) There are also minor and moderate indictable offences. In less severe cases can choose whether they want a jury or not (always tried by a judge, if really serious with jury) Hybrid offences are when the crown decides if a crime is summary (tried by a judge) or indictable (tried by both a judge or jury) All cases are heard by a judge but not all are heard by a jury (jury is time consuming and only used for most serious cases) In a trial with a jury, the jury decides the guilt and the judge decides the penalty. Represents the community in which the crime occurred ( representativeness ) Aboriginals are difficult to get on jury duty) Ex. in cases with a lot of pretrial publicity of the suspect. Required to show up even if there are extenuating circumstances.
