The injury may be physical (to the person or property of the victim), emotional or financial. Tort law determines in which circumstances the person who causes an injury must compensate the victim. Fault based but some torts do not require an element of fault (ex. nuisance) Punishment is left to criminal law if the action also happens to amount to a crime (ex. suing for battery when punched in the nose is also a criminal offense of assault) Tort law is between individuals: balance of probability need 51% proof of cause, must easier to prove. Criminal law is between individuals and the state: beyond a reasonable doubt, much harder to prove.
