The inescapable generality of the law : the constitution as a living tree constantly changing and adapting to our society. The courts can help us change the rules according to where we are in time. Fundamentally the courts are assigned the rules of: judicial review: the power of the courts to overturn legislation or executive actions, or to sustain them.
