Overall structure of courts: main areas of court process: Main goals of courts: do justice, protect rights of individuals in conflict with law. Key role in cjs: mete out justice independently, monitoring function, hear criminal cases and appeals. Classification of offences: summary conviction offences, eg. Tried within 6months of when the offence took place. Indictable offences homicide, treason, sexual assault, armed robbery, dangerous driving etc. Can be tried in different courts depending on seriousness of offence and preference of accused. More serious intrusions against those charged pre-trial detention, photographing, fingerprinting for permanent record. Increased protections for accused option of offender requesting case be heard by judge and jury: hybrid offences dual. Assault, theft, fraud under , impaired driving etc. Crown has choice to proceed summarily or by indictment. Can change at any time before trial begins. To allow flexibility and fairness to tailor to individual cases/offender however also creates uncertainty and inconsistency.
