Now: take home exam given march 28th, and due april 11. Not criminally responsible on account of mental disorder. Bill c54- proposed on the heels of the case of vince li. He beheaded and cannibalized 22 year old man on a greyhound bus in 2008. The verdict doesn"t constitute an acquittal, but sits outside of the prison punishment. While the accused isn"t crimimnally responsible for behavior, the public requires nexus. An accused who is found ncrmd is diverted to provincial/terrotirial review board. They are specialized tribunals, and chaired by a judge, and include 4 members (1 must be a psychiatrist) protection from future violent behavior. The review board crafts a dispposition that both protects public as well as trying to provide opportunities for treatment for the underlying disorder of the offender (s 672. 54) The law reflects the principle that we don"t punish people who really didn"t know that what they were doing was wrong.
