When the law is created, it is not created out of a vacuum, it is created by human so it matters who makes because it influences how we view the law etc. Pipeda if we don"t have people to enforce the law, it has no standing the same is with pipeda. No one imagines they will be arrested and their phones will be searched so lock your phones so that when the police asks to unlock your phone you could simply refuse. The police have the right to try to unlock the phone. In the case there wasn"t a password on the phone. You have the privacy interest in their phone. So even if you refuse, all they do is try to unlock their phone but if they cannot unlock it, then they cannot forcefully break into it. So just refuse until it ends up before the judge.
