The courts ability to operate runs on the consent of states. 121 states have agreed to the treaty which sounds like a lot but is quite deceiving. The 121 includes some authoritarian countries that employ repression or conduct military operations. Most of them are democracies that have some semblance of what the rule of law is. Icc only gains jurisdiction over a defendant if only domestic legal institutions fail to investigate internal crimes in good faith, therefore most member countries are likely to be subject to its jurisdiction.
