Lecture 7: definition of, positive, normative (question of legitimacy) Food + drugs: danger + deception, tabacco, abortion, economic activity , corporate crime, criminal law + civil remedy, federal power, issue of compensation as remedy, criminal law + regulatory authority, provincial power to punish. What remains questionable is whether or not they"re allowed to create remedies which compensate financial issues (crim rem) Provinces don"t actually have the power to punish, not in the same capacity as the federal power. At an ancillary level courts have accepted provinces authority. The supreme court has outlined the conditions and limitations which the provinces could utilize quasi forms of criminal regulation through law. Summary vs editable offence issues can be dealt with in a specific fashion (depends on the circumstance) Positive way of assessing whether or not some activity is considered criminal, positive way of determining whether or not the federal government has a way of punishing. A law exists if it actually exists.
