On one face, the rule of law represents a crucial means whereby the dominant rules and values in a society are applied and enforced. On the other, law represents a place where those rules and values are challenged and new ways of understanding may emerge. Aboriginal peoples are militarily powerful, possess unique knowledge & skills, control valuable land & territory. Competing empires (france v. england) and conflicts within empires (rebellious colonists) Aboriginal peoples are necessary military allies & commercial partners. Europeans were depends as hosts and guides, but over the course of time, they made relationships between the fur trades. They were quite military-powerful, and the europeans found them helpful. Europeans were unable to coarse the original way of the peoples. Relations regulated by negotiation between fn and the crown: treaties, two-row wampum belt. Recognition in practice (in law?) of internal autonomy. But: crown claims sovereignty over north america.
