SOSC 3360 Lecture Notes - Lecture 19: Law School Admission Test, Reverse Discrimination, Indian Act
Document Summary
Equality of opportunity = treaing everyone the same (everyone has a chance); everyone"s enitled to run the race (formal equality) a step up from having no equality. Equality of result = some equivalence; taking into consideraion the diferences of individuals when applying equality (substanive equality) The reason that its an issue is because when its played out, we are talking about taking a restricted access, or resources, and allowing only certain people access to it. Example: osgoode taking in 300 students taking the lsat and gpa (mixing it together to get one number). Ranked the students 1-300, and picked the irst 300 students out of all the applicants that fell closest to the number that they came up with: however, there isn"t a lot of aboriginal student within law school. The criteria is diferent in that we are taking on the basis of merit, as well as on the basis of race that"s unfair.
