Common law: unwritten law that came to us from england that we continued to use, time honored tradition of community (negligence: some parts of common law might be reflected in statutes. Difference between common and statutory law: statutory: written down in code, common: need to go back and read cases and see what the courts says about the cases. Difference between procedural and substantive law: procedural: want to get fair processes and fair system from the government, equal protection/due process, work to uphold rights in constitution. Fifth/fourteenth amendment: due process, fair, if the gov. is going to take away life, liberty, and property then you are due fair process.
