The most common complaint to HR is discrimination, the second most common is retaliation.
Disparate treatment is when an employer deliberately fires you because of your race.
Adverse impact is the systematic discrimination against a certain group of people. For example,
if the police department of Colorado only hired tall people, or only men.
If you feel discriminated against, you can either contact the HR department or the EEOC. The
EEOC is a place where you can file a complaint against a company discriminating you and it is
perfectly fine and confidential. However, they do keep track of frequent callers so they know
which complaints to take seriously.
Job relatedness means it is based off the job description, it has nothing to do with race, gender
or religion. Bona-fide occupational qualification is when you deliberately hire a person based
off of their race, religion or gender. Business necessity is when, for the safety of the company, a
specific gender, race, or religion needs to be hired/fired (extremely rare).
Recovering but not active alcoholics are protected and cannot be fired because of their
addiction, but any other drug abusers are not protected and can be fired for their addiction
whether they are recovering or active.
The unpaid leave act states that women cannot be paid while they are on maternity leave. The
US and Papa New Guinea are the only two countries on the planet that do not have paid leave.
Job analysis is a deconstruction of a job in which H/R assorts the job into tasks, responsibilities,
requirements and other. Job functions include tasks, which are also known as competencies.
KSAOs (knowledge, skills abilities, other) allow you to do a task. Knowledge is the knowledge of
the job. Skills is your ability to do the job, abilities are your physical and mental capabilities for
