If the state or federal government show a compelling general interest they can regulate it, ex: they can prohibit you from saying you have a bomb in the airport if you don"t. Commercial speech advertising and regulable by federal government and for intrastate commerce in for state. All the side effects in the pharmaceutical ads that was regulated by the government and regulatory agencies. Regulations regarding time, place, and manner as well. Ads cannot be false (makes you reach the wrong conclusion), misleading, or deceptive.
