Sunna: the prophet commended a judge who said that if he did not find a solution to a case in the koran or sunna he would exercise discretion (analogy) Original rule -- you cannot drink wine. Novel case -- can"t drink fermented date juice. Leads to formulation of more general rules and categories. Our example = all intoxicants are forbidden. Caliphal system of justice (caliph"s (rulers) appointed qadi) Qadi apply the law revealed to the scholars. Authority was linked to the religious knowledge and not power.
