Marshal seized papers and aricles including lotery ickets and other lotery- related documents: ph: defendant unsuccessfully peiioned district court for return of items seized during the warrantless search on ground that it violated his 4th rights. He was indicted on 7 counts, and the one that carried a federal convicion for transporing lotery ickets by mail. The police then beat him up and stomped on his stomach in an efort to make him throw up. When that didn"t work, they took him to hospital where they instructed doctor to pump his stomach. He then vomited the capsules and was convicted on basis of evidence produced from his vomit.
