Hypotheticals are essential because supreme court cases establish a precedent. Prior cases used as precedent in this case: rakas, jones. The us supreme court is the only court that sets precedent for all other us courts. Both lawyers from each side give about 100-page briefs that are read prior to the case by the us supreme court justices. Who won or who lost is not relevant to the case. A good question to ask: what is the test that the court has established? . If lower courts don"t mention something, it"s not relevant to the supreme court. Insurance and contract law is not viable in waiving fourth amendment rights. Rowland case (found in textbook) ended in probation. Prosecutors have the largest authority, then judges and juries follow. In the us, there is one federal constitution and 50 state constitutions. Members are voted for directly by citizens.
