Lowest bidder: not necessarily awarded the contract must be responsible. Possession of facilities for carrying out the contract. Ability to perform the contract in a timely fashion. Obligations then assumed or to be assumed. If there is a challenge, due process must show the authority made a thorough investigation of the facts and the lowest bidder had an opportunity to present his qualifications. Bidder must be qualified to bid on a particular job (license, etc) In addition to failing to disclose the scoring process to bidders, after a determination that all bidders were responsible, the city decided to award the project to the most responsible bidder. Court gave attorney"s fees to the gc for the first time. The awarding authority rescinded its selection of the protestor after another builder threatened litigation. Without evidence of illegality, fraud, oppression, or misconduct, the protestor was without remedy against the awarding public authority.
