Somebody"s charged, then comes issue of bail (becoming major issue because a lot of people argue that bail is punishment) Bail is an insurance policy that you"re actually going to show up for trial. Make a motion that it"s violation of 18 amendment. Alternatives to bail: ror (release on your recognizance) Conditional bail: release you under promise you go to drug treatment; if you don"t show up then you have to pay that money. Confrontation claus: right to confront your accuser and witnesses in court to cross examine them (part of 6th amendment) Hear say evidence: not allowed; out of court statement made where declared is unavailable. > if you say someone else said something but don"t say who told you that.
