Understanding agency is crucial to understanding the legal environment of business. Employment law: started long time ago by common law-usual laws that apply, gone opposite direction of contract law, supply gap filling language in contract law. Statues exist to protect the employee against the employer. Policy that has arisen is that employer has all bargaining power. Common law contracts have been modified by ucc (articles 1-9 that modify common law of contracts, do business in ordinary course, body of law that gives weight in legitimate business body expectations- flexibility & dependability) Fine with freedom of contract, but other areas such as policy we"re not-no freedom for policy reasons.
