Millions of indigenous people were killed either through straight up violence, enslaved and worked to death in mines, killed through bio-warfare(deliberately spreading disease). A model of lawmaking in which crime is seen to be socially injurious and therefore, laws are a rational response to resolving these disturbances. It"s one of the most simplistic theories that suggests laws were created to protect members of society from social harm, resulting in it being one of the most widely accepted theories of lawmaking. The rationalistic theory is based on what society or powerful interest groups (vago and nelson) deem as harmful, therefore it is subject to change as values change over time. Proposes that laws( criminal laws in particular) are created as a rational means of protecting the members of society from harm. In this perspective, crimes are considered socially injurious.
