The charter of rights and freedoms (a) section 1: limitation clause. The canadian charter of rights and freedom guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society . If objective very big and violation very small, government will win. R. v. oakes (1986)(scc) (b) section 2: fundamental freedoms. Freedom of expression: rjr-macdonald inc. v. canada (1994)(scc) Freedom of religion: r. v. big m drug mart (1985)(scc) Section 3: in canada can vote and run for office. Section 4: no government should be more than 5 years. Section 5: legislature has to meet at least once every 12 months.
