There is no common law right to privacy in countries that have inherited their legal system from england (e. g. australia, canada, usa, ) Privacy is protected by statute (codified) law. Quebec protects privacy in charter of human rights- everyone has right to privacy. Eavesdropping by electronic or mechanical means, like bugging. If you can hear it over the phone or within earshot, it is not considered illegal- must have permission from one person in the conversation (yourself or another): trespass at night (near a private dwelling) Criminal offense- worse at night because actions not visible. Element of surprise- not expected at night: intimidation (hounding, watching) Someone in pursuit of a story that entails repetitive surveillance of someone"s house.
