Criminal law is about public security, the rights of an accused, how to we determine what is just/no just, how do we determine what a crime is, how do we determine what the consequences should be, etc. We are interested in how to address the issues. There is an evolution in society that affects our law. Criminal code is a law that was enacted by parliament, whom represents us. It is not private law, between two people. Rather, it is public law and the state charges someone. Criminal law is also about losing your liberty (i. e. imprisonment). If we used the balance of probabilities, we would be convicting innocent people, thus the burden is much higher. If you don"t make the right choice and if that choice is serious enough, the state will be interested. How do we want to balance protecting rights, how much do we want police to be involved (procedure), etc.
