Substantive (what is wrongful conduct sought to be controlled/ what the state defines as criminal) procedural aspects (how does the state achieve control) Three related themes: privatization of justice system, example: private enforcement and private protection that discriminates on the basis of class, unintended consequences of law and order policy choices. Canada to pass in relation to the criminal law: provincial jurisdiction/authority, section 92 (14) - administration of justice, this makes them responsible for running the justice system at large. 7-14 set of process rights that consists of substantive and procedural perspectives. And the constitutions puts limits on what the government can do and how they interact with us. We might have to prove that our rights have been violated but not that we have the right in the first place. The constitution says the government cannot infringe upon our rights and liberties. Section 33 (!!!: view diagram on lecture slides if needed, our courts are heirarcale in their structure.
