In this actual case they both killed yuri and ate him, and 2 weeks later a ship found them. The jury believes them to innocent of murder, but the judge decided not to take their opinion and decided to convict them of murder. At the time it means they would be hanged, however the queen decided otherwise. The judge decided to do this because he did not want other cases to use this case as a reason for others not to be convicted of murder. Another question would be what if the 3 men decided to make a contract where whoever had the shortest straw will be killed.
