Document Summary

J&h ritchie v lloyd ltd [2007] ukhl 9. Section 35(6): the buyer is not deemed to have accepted the goods merely because he asks for or agrees to their repair by or under an arrangement with the seller. Buyers bought farming equipment from sellers and used it the day after receiving it and noticed some defect. They got in touch with the seller and so the equipment was taken back to be examined and possible repair. The parties don"t make any express agreement if the goods are defective. The sellers discover that parts of it are missing - major defect. They fix it by fitting the missing parts. The buyers are told that the repair has been carried out, but the seller didn"t disclose what was wrong, the buyer finds out about it though. They rejected the farming equipment because the information was refused. The question arose as to whether they were entitled to refuse the goods at this stage.
