Constitution builders may create different types of representation not only by adding a second chamber at the national level, but also by providing legislatures at different levels of government. The allocation of powers to legislative subunits depends on the diversity of a particular country. The devolution of powers in many policy areas depends on the circumstances and the balance of interests at stake: variations in the form of distributing legislative authorities. A constitution might assign legislative authority exclusively to the national or subnational levels. Such an allocation confronts two challenges, first, after a violent conflict caused by the marginalization of certain regions, competing factions will probably disagree to assign power exclusively to any level of government. Second, practical challenge is that it relies only on exclusive powers which may ignore the fact that there is often inevitably a subject matter and jurisdictional overlap in many areas of regulation.
