Document Summary

Close to home: 1 in 3 or 4 canadian women sexually assaulted in their lifetime, 80-85% of victims of sexual assault are female, perpetrators are often male. Violence = predictable outcome of hegemonic codes of masculinity: linked to sexism, misogyny, and homophobia. Sexual violence don"t fit the mythical norm of a typical rape victim, less likely to attain a conviction the text of the law is okay but those enforcing it tend to ignore the actual text. In civil it"s the balance of probabilities but in criminal law its beyond reasonable doubt, higher burden of truth makes it hard to convict because of low conviction rates victims find other ways of dealing. Rape myths have been key factors in making the law. The law is set up around the mythical norm that sexual assault is committed between strangers. This myth is seen as normal in sexual assault law.
