Document Summary
Incapacitation preventing persons from committing crimes by physical restraint, for example, incarceration: some believe it is unjust, unnecessary, counterproductive, and inappropriate, unjust offenders who committed the same crime receive shorter sentences, unnecessary offender not likely to offend again, counterproductive when prison increases the risk of subsequent or habitual criminal behavior, inappropriate offender has committed an offense entailing insignificant harm to the community. Judges have a variety of options: death penalty: 36 states; designated a capital crime, incarceration: sentenced to serve a term in a local, state, or federal prison/jail, probation: period of probationary supervision w/in a community, split sentence: between a period of probation and a period of incarceration, restitution: required to provide financial reimbursement to cover cost of victim"s losses, community service: required to spend a period of time performing public service work, fine: required to pay a certain sum of money as a penalty as an alternative or in conjunction with incarceration.
