LEGL-210 Chapter ch1-8: LEGL 210 Notes
Document Summary
Sophisticated client: someone who understand the importance of the solicitor client relationship and knows the importance of a lawyer. Knows when to represent self vs. when and how to hire a lawyer. Understanding of costs involved and how to report dissatisfaction with her lawyer. Good business choices cannot be made without conferring with the law; having a lawyer is necessary if you a)can"t obtain the legal information you need or b)can"t understand the information you have. Burden of proof: the burden of proof is on the plaintiff in a civil lawsuit; must prove case on a balance of probabilities. Evidence can be tangible (ie bloody knife), a piece of documentation (ie contract), or an eyewitness account. Hearsay: second hand evidence, not tangible in a court of law (ie your word against theirs-get it in writing) Client should be the decision maker, the lawyer is consulted but the client can always ignore legal advice they receive.
