Introduction
The law divides property into two categories: real property and personal property
Real property refers to land and anything attached to or beneath the land (i.e. buildings
and minerals)
o The owner of the land owns everything on the land, including minerals, unless
otherwise legislated or belong to the Crown by virtue of original grant
Personal property includes tangible and intangible things (i.e. computers, shares in a
company)
Intellectual property has gained prominence through recent years (property derived
from intellect works of art, musical creations, inventions, etc.)
As this module focuses on property law, the rest of the introduction is omitted.
Property Law
The law recognizes two types of property: real and personal property.
Real Property
Law relating to real property is based on concepts evolved in Norman England 1000
years ago
o Exception: Quebec. Property law is derived from France
Recall from earlier chapters that the feudal system was introduced after the Norman
Conquest of 1066 by William the Conqueror
o The country was divided into approximately 1500 parcels of land over which the
King’s barons were given rights
o Baron’s control over land was dependent on giving continued support and
military to the King
