Until the 1300, all suspected of committing a crime subjected to the same system of investigation, adjudication, and punishment. English common law recognized that young children should not be held to the same level of responsibility as adults. Until 1602 there was no mandatory system of birth registration so it was impossible to know with certainty a child"s age. Between the early 1300s and early 1600s, children were held to an adult standard of liability if : a physical examination revealed the onset of puberty, the crown could prove malice. By the early 1600s, children under the age of 7 were not criminally liable for their actions. 7 and 14 years were criminally responsible only if the crown could prove malce. Together, these two concepts became known as the doctrine of doli. Incapax, a principle that was incorporated into canada"s first criminal code in 1892.
