Tremblay applied for injunction from quebec superior court to prevent former girlfriend diagle from obtaining an abortion of their child decision. Judge deemed tremblay to have proper "interest" for applying and granted the fetus the right to life. Injunction was appealed, less than three weeks later the quebec court of appeal upheld lower court"s. Thirteen days later supreme court of canada interrupted summer vacation to hear arguments. Diagle 22 weeks pregnant when supreme court heard her case. This made tremblay v. diagle the speediest court case in canadian history. She had liberately tried getting pregnant when together with tremblay and therefore was only filing for an abortion since they had broken up. Incited that tremblay abused her physically during the relationship. Midway through the first day of oral arguments it was announced that diagle had defied the injunction and obtained an abortion in the united states. Thus making the case moot - but the supreme court continued hearing arguments.
