Two elements must be present for criminal guilt to be established: Issues of fitness, insanity, automatism, and mental disorders come into question. To be tried fairly, they should have understanding of the charges and proceedings and be able to help prepare their defence. Concluded an unfit person could not be sentenced. Evaluation can occur in detention, outpatient or inpatient facility. Fitness issue can be raised from time of arrest to sentence determination. Person is assumed to be fit unless court is satisfied with probabilities they are not. Table 8. 1 number ruled unfit by province. Need not have any experience in psychiatry or experience with forensic populations. Psychologists can assist with assessments and submit their results.
