In civil trials the right to trial by jury is not in the charter and its use has declined. The criminal code divides offences into 3 broad categories: summary offences: least serious offense, tried in lower court by judge alone, have not right to a jury trial (e. g. disruption of peace). Are punishable for no more than 6 months of jail and/or a max fine: indictable offences: most serious (murder, treason) will be tried in superior court with judge and jury. Crown and defence can request trial with judge alone in some cases: hybrid offences: either way offences can proceed either summarily (judge alone) or by indictment (judge and jury).
