Used both in criminal and civil cases. In criminal cases the right to trial by jury was carried over from england, now preserved in canada"s charter of rights and freedoms. In civil trials the right to trial by jury is not in the charter and its use has declined. The criminal code divides offences into 3 broad categories: summary offences: least serious offense, tried in lower court by judge alone, have not right to a jury trial (e. g. disruption of peace). Are punishable for no more than 6 months of jail and/or a max fine: indictable offences: most serious (murder, treason) will be tried in superior court with judge and jury. Crown and defence can request trial with judge alone in some cases: hybrid offences: either way offences can proceed either summarily (judge alone) or by indictment (judge and jury).
