Jones vs shafer estate 1948: jones truck wheels were coming of, pulled over on highway, placed 2 oil powered lares out on the road to alert other drivers, someone stole the lares. Shafer later crashed into truck and died: supreme court overturned trial and appeal judge decisions and said that jones was not negligent. Purpose of tort law: a primary objecive of the law of tort is to provide compensaion to persons who are injured as a result of the acions of others. Tort-feasor: a person who commits a tort, tort law seeks to shit losses from vicims to their tort-feasors who caused the loss. How torts are categorized: intenional torts a harmful act that is commited on purpose, examples: Assault the threat of imminent physical harm. Batery intenional inlicion of harmful or ofensive physical contact: negligence. Unreasonable conduct, including a careless act or omission, that causes harm to another.
