Initiated by a complaint or as a result of the police detecting evidence that a crime has been perpetrated. Law of criminal procedure aims to constrain the powers of the police and ensure that they are only exercised with just cause and with die respect for rights. Wishes of victims are considered but not determinative. Ca"s are quasi-judicial officers whose goal is to achieve justice. Ca"s screen cases and prosecute only cases that are in the public interest and for which there is a reasonable prospect of conviction. Must disclose the crown"s case to the defence before prosecution (but defense does not need to disclose to crown) Normally performed by private lawyers paid personally by the accused or by legal aid. A narrower role, directed almost exclusively at protecting the interests of the client: subject to duties owed to the court. Can assume an almost purely adversarial role towards the prosecution.
